Under standard criminal procedure, authorities must release the accused on bail after 90 days if charges are not filed. The law also allows police to summon individuals for questioning, but it does not grant police prearrest investigative detention authority. There were incidents in which authorities allegedly detained suspects beyond  legal limits. Article 244 and the 5th Schedule of the Constitution and analogous Land Transfer Prohibition Regulations forbid non-tribals from acquiring immovable property and settling in scheduled areas. Consequently, the tribals living in scheduled areas are isolated and confined to the jungles, cutting off their social, economic, and religious interactions with mainstream society.

The abject backwardness of tribals living in scheduled areas starkly contrasts with the better socio-economic and political development of tribals living outside the scheduled areas and within mainstream society. No estimates exist regarding the fatalities in militancy-related violence during the pre-1992 period in the northeast. According to the Indian Ministry of Home Affairs, from 1992 to 2015 over 15,600 fatalities have been reported from each of these states, though the actual number is believed to be much more. Even as there were signs that there has been some improvement in the insurgency situation in the North East, with the level of violence declining and some insurgent groups showing signs of battle-fatigue, a sudden resurgence of insurgency in the region is turning out to be a cause of concern. Sasikala, general secretary of the Tamil Nadu ruling party, All India Anna Dravida Munntra Kazhagam-Amma, was convicted of corruption after the Supreme Court restored the trial court verdict in a 21-year-old case.
Most domestic and international human rights groups generally operated without government restriction, investigating and publishing their findings on human rights cases. There were more than three million NGOs in the country advocating for social justice, sustainable development, and human rights. The government generally met with domestic NGOs, responded to their inquiries, and took action in response to their reports or recommendations.

There is a view that tribal insurgency in the northeast is the result of a feeling of increasing marginalisation of the concerned tribal groups.

The ideological motivations have worn off many groups, who instead engage in criminal enterprise, often partnering with related ethnic armed groups in Burma. India has quelled many of the most violent insurgencies, yet others continue to simmer. For example, New Delhi is engaged in peace talks to end its longest-running rebellion, fought in Nagaland since 1953, but efforts to extinguish Naga resistance are hindered by the existence of over a dozen Naga splinter factions.
According to Freedom House, internet freedom declined slightly in 2016, offsetting gains made in 2014 and 2015. The  NGO reported the number of network shutdowns ordered by local authorities increased. The report documented incidents of physical attacks on internet users for content posted online and stated at least 17 individuals were arrested for information circulated on WhatsApp, including group administrators based on content shared by other group members. The National Security Act allows police to detain persons considered security risks anywhere in the country, except the state of Jammu and Kashmir, without charge or trial for as long as one year.
